Kathmandu— The United States has implemented import restrictions on specific archaeological and ethnological materials originating from Nepal, effective August 12, 2026. The move follows a bilateral agreement signed by both countries in January 2026, initiated by a request from Nepal in May 2023 to bolster international protection of its cultural heritage and combat the illegal excavation, export, and trafficking of culturally significant artifacts. The restrictions target defined categories of materials based on criteria including material type, cultural context, and age, rather than imposing a blanket ban on all Nepali art or antiques.

Origins of the Agreement

Nepal first formally requested the U.S. government to impose these import restrictions on May 23, 2023, seeking to strengthen protections for its cultural heritage. This request led to a bilateral agreement signed on January 8, 2026, and subsequently formalized through a rule published in the U.S. Federal Register on August 12, 2026, by the U.S. Customs and Border Protection (CBP).

Scope of Restrictions

The restrictions do not constitute a complete ban on all cultural items from Nepal. Instead, they apply to specific categories outlined in an official Designated List accompanying the Federal Register rule. Archaeological materials include objects made from stone, ceramic, metal, plaster, ivory, glass, wood, and other organic substances, dating approximately from 32,000 BCE to 1770 CE. Ethnological materials encompass religious architectural elements, ceremonial objects, and manuscripts, with a timeframe of roughly the 13th century CE through 1950.

Protecting Nepal’s Heritage

Saubhagya Pradhananga, Director General of the Department of Archaeology, highlighted that the agreement acknowledges the importance of safeguarding Nepal’s cultural heritage while still allowing for legitimate exchanges between the two countries. She noted this is the first bilateral agreement of its kind, differing from broader international instruments like the 1970 UNESCO Convention on illicit cultural property transfers. Pradhananga also expressed hope that the agreement will aid in recovering illegally removed artifacts and preventing future trafficking.

The U.S. government anticipates these restrictions will help protect Nepal’s cultural heritage from looting, illegal excavation, and trafficking, supporting both preservation efforts and legitimate cultural exchange.
