Kathmandu— Chinese Premier Li Qiang has signed a State Council decree issuing a revised regulation on the protection of integrated circuit (IC) layout-designs, set to take effect on October 15. The update addresses rapid technological advancements and practical demands in the industry since the original regulation was introduced in 2001.

Enhanced Protection Measures

The revised regulation introduces stricter application procedures, requiring declarations of originality and clear indications of original parts. It also establishes mechanisms for rejecting non-compliant applications and revoking improperly registered designs. Infringement compensation will be based on actual losses or the infringer's profits, with punitive measures for serious cases.

Promoting Innovation and Application

To encourage innovation and application of IC layout-designs, the regulation mandates that relevant departments enhance public services. It also requires legal persons or non-legal person organizations to provide reasonable rewards and remuneration to eligible personnel who create these designs under their direction.

Supporting Frameworks and Enforcement

The revised regulation refines requirements for the transfer, licensing, and pledging of IC layout-designs. It also regulates the exercise of rights and distribution of licensing fees among co-owners. After its implementation, authorities will focus on publicizing the rules, improving supporting frameworks, and ensuring effective enforcement.
