China Issues Judicial Interpretation for New Ecological and Environmental Code

Kathmandu— On Thursday, China's Supreme People's Court issued judicial interpretations supporting the country’s newly adopted Ecological and Environmental Code. The provisions aim to clarify how courts should handle environmental cases under both old and new laws, ensuring a seamless legal transition when the Code comes into force on August 15.

Clarifying Legal Standards

The judicial interpretation consists of 13 articles that provide detailed guidance for courts. It outlines general standards and specific rules to be followed in handling environmental cases after the new Code takes effect. According to the provisions, cases based on facts occurring before August 15 will generally adhere to existing laws and judicial interpretations, while those arising afterward will fall under the jurisdiction of the Ecological and Environmental Code.

Scope and Objectives

The Ecological and Environmental Code, adopted by China's top legislature in March, comprises 1,242 articles divided into five chapters. These cover areas such as pollution control, ecological protection, and green and low-carbon development. The Code is designed to align with China’s commitments to peak carbon emissions before 2030 and achieve carbon neutrality before 2060.
