U.S. Refunds $100 Billion in Tariffs Struck Down by Supreme Court

Kathmandu— The United States has processed refunds totaling around $100 billion for tariffs that were struck down by the Supreme Court in February, according to a filing by US Customs and Border Protection (CBP). The refunds stem from additional ad valorem duties imposed under the International Emergency Economic Powers Act (IEEPA), which the court ruled invalid.

Supreme Court Invalidates Tariffs

In a significant ruling in February, the U.S. Supreme Court held that President Donald Trump lacked authority under the IEEPA to impose sweeping import duties on goods from nearly all U.S. trading partners. The court's 6-3 decision, authored by Chief Justice John Roberts, invalidated the tariffs and set the stage for large-scale refunds.

Refund System Launched

To address the massive refund effort, CBP developed a new system capability within its Automated Commercial Environment (ACE) platform called CAPE. This system became available to importers and customs brokers on April 20, 2026, allowing them to submit declarations for eligible refunds.

Processing and Disbursement

As of July 31, 2026, CBP reported that approximately $128.68 billion in potential and certified refunds had been accepted for processing through CAPE. Of this amount, about $100 billion has been completed using the CAPE Refund component, certified by CBP, and sent to the U.S. Department of Treasury for disbursement.
