Nepal Province Legalizes Medical Marijuana Use

Kathmandu— On Monday, Gandaki province in Nepal implemented a controversial bill that permits the cultivation and medical use of marijuana. The law was unanimously passed by both ruling coalition and opposition parties in the provincial assembly, despite a national ban on the substance. Farmers will need official permission from provincial authorities to grow cannabis and will be closely monitored.

Historical Context

Marijuana has deep roots in Nepal's cultural and religious traditions. The plant is native to the country, where it was widely used during festivals and ceremonies. However, in the late 1970s, Nepal joined other nations in outlawing marijuana as part of a global effort to expel the hippies who had flocked there for its liberal drug laws. Activists have long campaigned for legal changes to permit cultivation and use for medical purposes.

Legal Implications

The new provincial law sets a significant precedent in Nepal, as it directly challenges the national ban on cannabis cultivation, possession, and use. Under current national laws, possession of marijuana for personal use can result in up to one month in jail, while distribution and sale are punishable by up to 10 years' imprisonment depending on the amount involved. The Gandaki provincial law aims to provide a legal framework for medical use despite these restrictions.
